Terms of use for the application assistants of the Social Platform

The Social Platform is a service of the Ministry of Labour, Health and Social Affairs of the State of North Rhine-Westphalia (MAGS NRW). As a cross-state portal of the administration, the Social Platform is intended to provide users with electronic access to various administrative services in the field of labour and social affairs. To this end, the Social Platform contains information on individual administrative services and enables applications for benefits to be submitted electronically via so-called application assistants.

1. Scope of the Terms of Use

These Terms of Use regulate the relationship between users of the application assistants and MAGS NRW as the provider of the Social Platform. Every user must take note of the Terms of Use and accept them each time they use the application assistants. The MAGS NRW reserves the right to change the Terms of Use if necessary.

2. Entitlement to use and registration obligation

The users of the application assistants within the meaning of these Terms of Use are natural persons who wish to submit an application electronically via the Social Platform. The use of this service requires registration, which can be effected via the Servicekonto.NRW or a comparable account of another federal state or the federal government (for more details see 3.1), or by means of a new identity card or electronic residence permit. Only persons who have reached the age of 16 are entitled to use the Servicekonto.NRW. Users must agree to the transfer of user data to the application assistant when submitting their application.

3. Requirements for the use of the application assistants

3.1 Authentication

The application assistants require authentication of users via the Servicekonto.NRW or a comparable account of another federal state or the federal government. For the use of some functionalities, authentication and, if necessary, identification with the online ID card function of the ID card or the electronic residence permit is required. The online ID card function must be activated for this purpose. For the registration and use of the Servicekonto.NRW or a comparable account of another federal state or the federal government, additional hardware and software may also be required. The AusweisApp2 can be used to read personal data from the ID card into the Servicekonto.NRW or a comparable account of another federal state or the federal government. To do this, you need either a card reader or a suitable smartphone. Further information on this can be found at www.servicekonto.nrw and at www.ausweisapp.bund.de.

3.2 Further technical requirements

The Social Platform can be accessed via the website www.sozialplattform.de.

The use of the application assistants requires:

  • Internet access,
  • a browser (e.g. Chrome, Firefox or Safari) in the latest version,
  • the activation of Java script in the browser,
  • enabling cookies and
  • an email address (if applicable for the creation of a user account such as the Servicekonto.NRW).

Only the "Portable Document Format" (PDF) or image files in PNG, JPEG or HEIC format are permitted as storage format for files to be uploaded in the application assistant. A file must not be larger than 10 MB. In total, the application with all attachments must not exceed 30 MB.

3.3 Intermediate storage in the application process

Users have the option to interrupt the application process. The application is temporarily stored on the Social Platform. This enables users to obtain the necessary information or documents that are needed at the time of application but are not yet available.

4. Availability of the application assistants

The MAGS NRW provides access to the application assistants on the Social Platform within the scope of its technical and organisational possibilities. In principle, the application assistants are available to users at any time. Due to maintenance work, disruptions or force majeure, the accessibility of the Social Platform may be restricted or suspended. Users are, however, not entitled to a constant, uninterrupted accessibility of the application assistants. Nonetheless, the operation of the Social Platform is organised in such a way that technical problems are solved promptly.

Due to maintenance work, malfunctions or force majeure, the delivery of an already sent application to the competent institution may also be delayed. Once an application has been sent, users are not entitled to demand a specific date of delivery.

5. Access and receipt of electronic documents

An application is only considered to have been submitted when the relevant data set has been received by the competent institution via the application assistant of the Social Platform. After completing the application wizard, it is possible to download a confirmation that the application has been sent via the Social Platform.

6. User obligations

6.1 Complete and correct information

Users are obliged to provide up-to-date, complete and correct information on the requested data in the application assistant. Incorrect information, e.g. on income or assets, may have legal consequences, such as the non-processing or rejection of an application, the refusal of a benefit, e.g. due to lack of cooperation according to § 66 SGB I, claims for repayment by the competent institution or criminal consequences, e.g. according to § 263 StGB for social benefits fraud.

6.2 Keeping the password secret

Users are solely responsible for maintaining the confidentiality of their password for the Servicekonto.NRW or a comparable account of another federal state or the federal government. They are also solely responsible for all activities carried out using their registration. They are obliged to inform the competent institution immediately of any unauthorised use of their registration or any other breach of security.

The MAGS NRW is not liable for damages incurred by users as a result of third parties using their passwords or registrations for the Servicekonto.NRW or a comparable account of another federal state or the federal government on the Social Platform with or without their knowledge. Users may be held liable for damages and expenses incurred by the competent institution or another party due to the use of the users' registration or password by a third party, insofar as the users are at fault.

6.3 Use of the application assistants

The use of the application assistants of the Social Platform is permitted on condition that the users do not use the services for purposes which violate these Terms of Use or which are unlawful. This includes in particular any dissemination and transmission of illegal content, in particular pornographic content, content glorifying violence, discriminatory content or content that offends common decency. The mass, unsolicited sending of content irrelevant to the application process (spamming) is also prohibited.

The application assistants may not be used in any manner that could damage, disable, overload, or impair any server or network of the operators of the Social Platform or any third party network or server, or interfere with any other party's use of the application assistants. The uploading of electronic data of any kind not related to the application process is generally not permitted.

Users are not permitted to gain unauthorised access to registrations, computer systems or networks connected to the server of the above-mentioned data centres by decrypting codes, illegally obtaining passwords or any other methods.

6.4 Right to block user access in case of breach of user obligations

In the event of a breach of these Terms of Use, in particular of the user obligations under para. 6.3, the user may be permanently or at least temporarily blocked from using the application assistants. The blocking only applies to applications submitted electronically. Applications by post or in person are still possible and remain unaffected by the block.

6.5 Obligation to cooperate and control

Users are obliged to immediately notify the competent institution of any changes in their contact details, in particular the e-mail address deposited for contact purposes, stating the transaction number. They shall regularly check their e-mail box for the receipt of new messages from the operators of the Social Platform or the competent institution. If messages are delivered by e-mail and the user does not react to them, this may have adverse consequences, e.g. a later benefit or a rejection of the application due to missing information.

6.6 Obligation to retain and provide documents

If copies or scans of original paper documents have been uploaded and sent in the course of the application, these paper documents must be kept in safe custody beyond the submission of the application until at least the conclusion of the procedure and must be submitted to the competent institution without delay upon request. This applies in particular to deeds and other authenticated documents. Statutory retention periods remain unaffected.

After submitting the documents, users will receive an overview of the application data (application overview) as well as a confirmation of the submission of the application for download. This includes a process ID-number. The users are obliged to safely retain this data and to make it available upon request of the competent institution. In the event that an application is not received by the competent institution despite being sent, the confirmation of dispatch must be made available to the operator of the Social Platform upon request if the data can thus be traced.

7. Copyright

Texts, images, graphics, files as well as the design of the internet pages of the Social Platform, in particular also the application assistants, the underlying structure and the contents, are subject to copyright in whole or in part. The users have the right to use the Social Platform, the application assistants and the information and content contained therein for the purpose of submitting applications. Users are not granted any further rights. Reproduction or use of the contents or parts thereof in other electronic or printed publications and their publication is only permitted with prior consent. § 53 German Copyright Act (UrhG) remains unaffected.

8. Data protection

The processing of personal data on the Social Platform and in the context of the use of the application assistants is carried out as described in the privacy policy.

9. Costs, fees

The use of the Social Platform is free of charge for the users. When using the service telephone number indicated on the Social Platform, there are no costs in addition to those stipulated in the users' plan.
